If you have received a notice from the Professional Tax Department (PTEC / PTRC) in Maharashtra — you are not alone. In the last few months, thousands of businesses, freelancers, shop owners, and companies in Navi Mumbai and Mumbai have received these notices. Most people do not understand what it means and what to do next. This blog will explain everything in simple language.

The notice says something about PTEC or PTRC. And most people have no idea what this is, why they got it, and what they are supposed to do now.

So I am writing this blog to answer every question you have — in simple, plain language. No legal jargon. No confusion.

First — What Exactly is PTEC and PTRC?

Professional Tax is a small tax collected by the Maharashtra State Government from anyone who earns income through a profession, trade, business, or employment. The maximum amount is just ₹2,500 per year. It sounds small — but ignoring it can create very big problems.

There are two types of registration under Professional Tax:

Simple way to understand it: PTEC = you pay tax for yourself. PTRC = you deduct and pay tax on behalf of your employees. If you run a business with even one employee earning above ₹7,500 per month — you need both.

Why Did You Receive This Notice?

The Maharashtra GST Department has recently upgraded to a new portal — mahagst.gov.in — and has started cross-checking data from GST registrations, company registrations (ROC/MCA), and income tax records.

Here are the most common reasons people in Navi Mumbai are getting these notices:

Reason 1 — Never Registered for PTEC / PTRC
You started a business, got GST registration, maybe even registered a company — but never got PTEC or PTRC. The department has now matched your records and is asking you to register and pay arrears for past years.

Reason 2 — Registered but Stopped Paying
You had PTEC or PTRC earlier but stopped filing returns or making payments. The department is now sending notices for the pending amounts with interest and penalty.

Reason 3 — PTRC Not Taken Even Though You Have Employees
Many small businesses in Navi Mumbai do not know that once they hire even one employee above the salary threshold, they are legally required to deduct professional tax and register for PTRC.

Reason 4 — Wrong Period Payment or Wrong Registration
Some people have paid under the wrong head, wrong period, or wrong certificate number. The system shows it as unpaid and sends a notice automatically.

Reason 5 — Portal Migration Issues in 2026
The Maharashtra department recently moved to a new portal. Due to system migration, many taxpayers who had already paid were still shown as defaulters. The government issued a relaxation circular in March 2026 to address this.

What Are the Penalties If You Ignore This Notice?

⚠️ Please do not ignore a notice. The longer you wait, the more it costs you.

  • Delay in Registration: Penalty of ₹5 per day from the date you were liable to register.
  • Late Payment Interest: 1.25% per month for the first month. Then 1.50% for next two months. Then 2% per month after that — compounding every month.
  • Non-Payment Penalty: 10% of the total tax amount due — over and above the interest.
  • Late Return Filing Penalty: ₹1,000 per return if filed within 1 month of due date. ₹2,000 per return if filed after 1 month.
  • Arrears Demand: The department can demand arrears for up to 8 previous years of unpaid professional tax — with full interest and penalty on each year.

I have seen clients come to me with a ₹2,500 per year tax that has now become a demand of ₹80,000 to ₹1,00,000 — only because they kept ignoring it for years. Please do not let this happen to you.

Latest Updates for FY 2025-26 You Must Know

February 2026 Amendment PTEC now payable by 15th June every year. PTRC monthly returns due by 15th of following month. Annual PTRC return due by 15th March.
March 2026 Relaxation Government gave one-time relaxation for March 2026 compliances due to new portal migration. Delayed registrations allowed till 30 April 2026.
Women Employee Exemption From April 2023, women earning up to ₹25,000 gross per month are fully exempt from Professional Tax.
New Refund Facility From February 2026, if you have overpaid Professional Tax, you can now apply for a refund online through mahagst.gov.in.
New Portal All payments, registrations, and returns are now processed through mahagst.gov.in — not the old mahavat.gov.in portal.

What Should You Do If You Have Received a Notice?

Here is the step-by-step action plan I give to every client who calls me after receiving a PTEC or PTRC notice:

  1. Do not ignore it. Read the notice carefully and note the last date mentioned. Missing it leads to ex-parte orders and bigger penalties.
  2. Check your registration status. Log in to mahagst.gov.in and check if your PTEC and PTRC are active, inactive, or not registered at all.
  3. Calculate your arrears. Work out how much professional tax was due from the date you became liable — including interest and penalty for each year.
  4. Apply for registration immediately if you are not registered yet. You can apply by 30 April 2026 under the relaxation given by the government.
  5. Pay the arrears and file pending returns. Clear all outstanding dues. This is the only way to stop the notice and avoid further penalties.
  6. Reply to the notice formally. Submit the payment receipts and registration details to the department as a formal reply within the given time period.
  7. Set up future compliance. Set a reminder every year for PTEC payment by 15th June and PTRC returns by 15th of every month.

Common Questions I Get From Clients in Navi Mumbai

Q. I am a freelancer / consultant. Do I need PTEC?
Yes. Every self-employed professional — whether you are a freelancer, doctor, consultant, accountant, trader, or shop owner — who is registered under GST or earning from a trade or profession in Maharashtra is required to obtain PTEC and pay ₹2,500 per year.

Q. My company has no employees. Do I need PTRC?
No. If your company has no salaried employees, you only need PTEC — for the company and for each director personally. PTRC is only required when you have employees earning above ₹7,500 per month.

Q. I am a director of a company. Do I need a separate PTEC?
Yes. Every director of a company is personally liable for PTEC. And even if you are a director of multiple companies, you only need one PTEC in your name.

Q. I already paid but still got a notice. What do I do?

Q. Can I get a waiver on the penalty and interest?
In some cases, yes. The March 2026 relaxation is one such opportunity. If you act now, you may be able to clear your dues with reduced or no penalties. But this window closes — do not wait.

Q. How far back can the department demand arrears?
The department can demand unpaid Professional Tax for up to 8 previous years. So if you have been unregistered since 2017 or 2018 — your total liability could be significant. The sooner you resolve this, the lower your exposure.

Q. My Partnership Firm got a notice. Do we need PTEC for the firm?
The Partnership Firm as an entity is exempt from PTEC. However, each individual partner is personally required to obtain PTEC and pay ₹2,500 per year.
